NOVELNIX TERMS OF SERVICE

Welcome to NovelNix (the "Service," "Software," or "Platform"), operated by Rebecca Camm  ABN 99 670 917 896 ("we," "our," or "us"). By accessing or using the product NovelNix and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. License and Scope of Service

NovelNix provides a Software Application platform designed for writers, authors, document management. Subject to your compliance with these Terms and payment of the applicable fees, we grant you a non-exclusive, non-transferable, revocable, limited license to access and use the Service for your personal or internal business purposes.

2. Purchase Model, Updates, and Upgrades

Unlike traditional recurring subscription models, NovelNix is sold on a version-specific baseline.

  • One-Off Purchase: Your purchase of a specific major version of NovelNix (e.g., Version 1.x) is a one-time fee that grants you the right to use that specific version indefinitely, subject to these Terms.
  • Included Updates: Your purchase includes all minor updates, maintenance releases, bug fixes, and patches within that major version cycle (e.g., updates from 1.0 to 1.1, 1.2, etc.).
  • Major Version When a new major version of the software is released (e.g., Version 2.0), it is considered a separate product offering. Access to new major versions is not included in your original purchase.
  • Upgrade Pricing: Existing customers will be given the option to purchase an upgrade to the new major version at a discounted or promotional upgrade price, at our sole discretion. You are under no obligation to upgrade; you may continue using your purchased version, though support and maintenance for legacy versions may eventually be discontinued in accordance with our lifecycle policies.
3. Accounts and Security

To use NovelNix, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. Data Storage, Privacy, and Backups

NovelNix is a locally downloaded application. All software processing occurs on your local device, and any content, text, or data you create, upload, or edit within the Software is stored exclusively on your own computer’s local storage. We do not host, store, sync, or back up your content on our servers. Because your data never leaves your device, you acknowledge and agree that:

  • Backup Responsibility: Maintaining secure, regular backups of your content is entirely your responsibility. We are not liable for any data loss, corruption, or inability to access your content due to hardware failure, software issues, or accidental deletion.
  • App Acknowledgement: You acknowledge that this data structure is clearly stated upon the initial opening and setup page of the application to ensure user awareness.
5. Intellectual Property Rights
  • Our Property: All right, title, and interest in and to NovelNix, including the software, design, text, graphics, logos, and underlying code, are and will remain the exclusive property of Rebecca Camm and its licensors.
  • Your Content: You retain all intellectual property rights and ownership over any data, text, files, or information that you upload, create, or store within your NovelNix account ("User Content"). We do not claim any ownership rights over your Content.
6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Software.
  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Abuse, spam, or overload our infrastructure.
7. Fees and Refunds

Pricing: All prices are as stated on our website and are charged as a one-off purchase fee for the specific major version selected.

Refund Policy: Because NovelNix is a digitally downloaded software product that is delivered instantly upon purchase, Refunds are covered in the refund policy. We highly encourage you to review all product descriptions, system requirements, and available documentation before making a purchase.

Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any guarantees, rights, or remedies implied by the Australian Consumer Law (or equivalent local consumer protection laws in your jurisdiction) that cannot be lawfully excluded. If the Software fails to meet a statutory consumer guarantee (e.g., if the software suffers a major technical defect that prevents it from functioning as advertised), you will be entitled to a remedy in accordance with those laws.

8. Limitation of Liability and Warranties
  • "As Is" Basis: NovelNix is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
  • Limitation: In no event shall Rebecca Camm be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of these Terms shall not exceed the total amount paid by you for the software version in question.
9. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also stop using the Service at any time.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the courts located in Victoria, Australia.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the date at the top of this document or via email. Your continued use of NovelNix after such changes constitutes acceptance of the new Terms.
